Welcome to EverGuard. These Terms of Service (“Terms”) govern your access to and use of EverGuard’s website, applications, and services (collectively, the “Services”).

By creating an account or using the Services, you agree to these Terms.

EverGuard Services

About EverGuard

EverGuard provides identity protection and monitoring services designed to help individuals identify potential risks involving their personal information.

Scope of Services

Services may include:

• identity monitoring

• dark web monitoring

• credit monitoring

• public records monitoring

• personal data monitoring

• data removal assistance

• fraud and scam alerts

• neighborhood safety monitoring

• identity theft insurance (via third-party provider)

EverGuard may modify, suspend, or discontinue any aspect of the Services at any time without notice.

Monitoring-Only Nature of Services

EverGuard provides monitoring and alerting services only.

EverGuard does not:

• prevent identity theft

• block fraud

• stop unauthorized transactions

Users remain responsible for protecting their accounts and financial activity.

Account Eligibility and Registration

Eligibility Requirements

You must be at least 18 years old to create an account.

You represent that:

• all information provided is accurate

• you are authorized to submit the information being monitored

Account Creation

You must create an account to access certain Services.

Accounts are structured as:

• one billing owner account

• one or more associated profiles

Profiles may include:

• adult profiles

• child profiles (Family plan only)

Account Security and Responsibility

You are responsible for:

• maintaining account credentials

• all activity under your account

You must notify EverGuard of unauthorized access.

Monitoring Services

General Monitoring Services

EverGuard monitors various public, commercial, and third-party data sources to identify potential risks.

Alerts are generated based on available data and detection systems.

Credit Monitoring Services

• Credit monitoring is provided through third-party providers.

• EverGuard is not a credit bureau.

• Credit data may be delayed, incomplete, or inaccurate and is subject to the reporting practices of third-party providers.

• Credit scores may differ from lender scores.

Public Records and Neighborhood Monitoring

EverGuard may provide information from public records and third-party databases.

This may include:

• public safety data

• registry data

• property or address records

EverGuard does not guarantee accuracy of public records.

Data Availability and Coverage Limitations

Monitoring coverage depends on:

• data availability

• geographic limitations

• third-party data sources

EverGuard does not guarantee detection of all identity theft or fraud events.

Information provided through the Services may be incomplete, outdated, or inaccurate.

Insurance and Third-Party Services

Identity Theft Insurance

Certain plans include identity theft insurance coverage.

Provided under a group or blanket insurance policy issued to Enfortra, Inc. for the benefit of eligible EverGuard members.

Subject to the insurer’s terms and conditions.

EverGuard does not administer claims.

Third-Party Providers

EverGuard relies on third-party providers for:

• monitoring data

• credit services

• insurance

• data removal

Third-Party Terms and Limitations

Third-party services are subject to their own terms and limitations.

EverGuard is not responsible for third-party data accuracy or service availability.

Communications

Email, SMS, Calls, and In-App Notifications

You agree that EverGuard may contact you via:

• email

• SMS/text

• phone calls

• in-app notifications

Service Communications

Communications may include:

• security alerts

• monitoring notifications

• account updates

• onboarding guidance

• support communications

Opt-Out Rights Where Permitted

You may opt out of certain communications where permitted by law.

Transactional and security-related messages may still be sent.

Acceptable Use

Lawful Use Only

You agree to use the Services only for lawful purposes.

No Unauthorized Monitoring

You may not monitor any individual without their authorization.

Prohibited Conduct

You may not:

• violate privacy or data protection laws

• attempt unauthorized access to systems

• interfere with Service operation

• bypass plan limitations or feature restrictions

EverGuard may suspend or terminate accounts for violations.

Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, and protect your information.

Billing, Changes, and Termination

Subscription Relationship

Use of paid Services requires an active subscription.

Subscription terms, billing cycles, pricing, and refunds are governed by the Subscription & Billing Terms.

Plan-Based Access and Feature Availability

Access to features depends on your active subscription plan.

Plans determine:

• number of profiles allowed

• access to shared dashboards and alerts

• availability of child monitoring

• insurance coverage levels

EverGuard may:

• restrict access to features not included in your plan

• enforce profile limits

• block plan changes that violate plan constraints

Plan Changes, Termination, and Suspension

If you:

• cancel your subscription

• downgrade your plan

• exceed plan limits

• violate these Terms

EverGuard may:

• reduce or remove access to features

• deactivate monitoring for removed profiles

• adjust insurance coverage

• suspend or terminate your account

EverGuard does not guarantee continued access to features not included in your active plan.

Disclaimers and Liability

No Guarantee of Fraud Prevention

EverGuard does not guarantee that identity theft, fraud, or financial loss will be prevented.

Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

EverGuard makes no warranties, express or implied, including but not limited to:

accuracy or completeness of monitoring data

reliability or timeliness of alerts

uninterrupted or error-free operation

fitness for a particular purpose

Use of the Services is at your own risk.

Service Availability

Services may be unavailable due to:

• maintenance

• system updates

• third-party disruptions

EverGuard does not guarantee uninterrupted access.

Limitation of Liability

To the fullest extent permitted by applicable law, EverGuard shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to financial losses, identity theft losses, loss of data, or loss of use.

EverGuard is not liable for losses resulting from identity theft, fraud, or unauthorized use of personal information.

Total liability for any claim shall not exceed the greater of: the amount paid by you to EverGuard in the 12 months preceding the claim, or $100.

Legal Terms

Governing Law

These Terms are governed by the laws of the State of Utah.

Dispute Venue

Except as otherwise provided in Section 1.29, any legal action permitted to proceed in court shall be brought in courts located in Utah.

Arbitration and Dispute Resolution

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration under the Federal Arbitration Act.

You agree to waive the right to a jury trial and to participate in any class, collective, or representative action.

Arbitration will be conducted by a mutually agreed arbitration provider or, if none is agreed, by a recognized arbitration organization.

You may opt out of this arbitration agreement by providing written notice to EverGuard within 30 days of first accepting these Terms.

Either party may bring claims in small claims court where eligible.

Indemnification

You agree to defend, indemnify, and hold harmless EverGuard and its affiliates, officers, employees, and partners from any claims, damages, liabilities, and expenses arising from:

- your use or misuse of the Services

- your violation of these Terms

- your violation of applicable laws or third-party rights

Intellectual Property

All content, technology, and materials provided through the Services are owned by EverGuard or its licensors.

You may not:

- copy, reproduce, or distribute content

- reverse engineer or attempt to extract source code

- use the Services for commercial purposes without permission

Force Majeure

EverGuard shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, cyberattacks, internet outages, labor disputes, or failures of third-party service providers.

Changes to Terms

EverGuard may update these Terms from time to time.

Continued use of the Services after updates constitutes acceptance of the revised Terms.
